Part 264s – Smith Robertson Genealogy – Indenture Research – 1827 Archibald and James Smith

Early Morning,

Supper was certainly a wee bit different; a memorable Thai salad- Laab and a main dish of Broad Beans and Shrimp. The actual recipe instead of broad beans called for stinky beans. Well I’m adventurous when it comes to cooking and eating, but once I read online that Stinky Beans “as the food to order when on a bad date” I opted to use the broad beans as a substitute.

Tonight’s Indenture in my Transcription Project, of my search for the origin of the genealogy and ancestry of ggg-grandfather James Smith is a Record, dated 15 June 1827 and entered to the Grenada Registers of Records 10 April 1828. This Record is the first part of a number of entries that cover a number of pages. I figured it would be easier to transcribe and interpret in short parts. And so the next few Transcriptions and Parts, I believe, will all appear to refer to a particular affair.

Further I do not believe that these Records are particular to ggg-grandfather James Smith. They appear to be applicable to one James and one Archibald Smith who, I think are of the “Jordan Hill Smiths”. See Part 261s for further cross-references to the associated Smiths.

Entered 10 April 1828

This Indenture made the Fifteenth day of June in the year of
our Lord one thousand eight hundred and twenty seven Between
Susannah Henrietta Pegus of Greenwich in the County of Kent
in England Widow Peter William Pegus of Stamford in the
County of Kent in England Clerk Henrietta Margaretta Pegus
and May Ann Jane Pegus Spinsters and Frederick Edward
Pegus also of Greenwich in the County of Kent Esquire of the one part
and James Smith, Archibald Smith and Robert McCunn all
of the City of Glasgow Merchants there trading under the firm of James
and Archibald Smith and Company of the other part Witnesseth that
for and in consideration of five shillings sterling money of Great Britain
to them the said Susannah Henrietta Pegus Peter William Pegus
Henrietta Margaretta Pegus Mary Anne Jane Pegus and Frederick
Edward Pegus in hand well and truly paid by the said James Smith
Archibald Smith, and Robert McCunn at or before the sealing and

Delivery of these presents the receipt whereof is hereby acknowledged
They the said Susannah Henrietta Pegus Peter William Pegus Henrietta
Margaretta Pegus Mary Anne Jane Pegus and Frederick Edward
Pegus Have and each of them Hath bargained and sold and by these
presents Do and each of them Doth bargain and sell unto the said
James Smith Archibald Smith and Robert McCunn their executors
administrators and assigns All that the plantation estate or parcel
of land situate lying and being in the Island of Carriacou in the
Government of Grenada aforesaid called or known by the name of the
Hermitage Estate and containing Two hundred and thirty five acres
of land more or less bounded on the East by the lands of the late Thomas
Davidson called Harvey Vale on the North by the Carenage and on
the South and West by the Sea or howsoever otherwise called Crown
situate lying or being bounded or distinguished and the Messuages or
Dwelling houses Kitchens Stables Houses Authorises Stores Tenements
Erections or Buildings and pictures thereon or thereto attached And all
ways waters watercourses passages cisterns ditches woods underwoods
Trees Orchards Fences Hedges Plantation implements and utensils
easements emoluments profits and advantages whatsoever now on the
said plantation estate or parcel of land and premises or to any past thereof
in any wise belonging or to or with the same or any part thereof usually
held possessed or enjoyed or accepted deemed or known as parcel or member
thereof And all those Forty eight Negro Slaves thereto belonging whose
names are set forth in the Schedule A annexed to the Indenture of
Release to which these presents refers with the future issue and increase
of the females thereof And also all those Thirty negro Slaves whose
names are set forth in Schedule B also annexed to the said
Indenture of Release to which these presents refers with the future
issue and increase of the females thereof and the reversion and reversions
remainder and remainders rents issues and profits of the said plantation
estate or parcel of land hereditaments slaves and premises To have and
to hold the same plantation estate or parcel of land meʃsuages tenements
hereditaments slaves and premises hereby bargained and sold or intend
ed so to be with their and every of their appurtenances unto the said
James Smith Archibald Smith and Robert McCunn their executors
administrators and assigns from the day next before the day of the date
of these presents for and during and until the full end and term of

Yielding and Paying therefore at the expiration of the said time
the rent of one pepper corn if demanded to the intent and purpose
that by virtue of these presents and by force of the statute made for
transferring uses into poʃseʃsion they the said James Smith Archi
bald Smith and Robert McCunn may be in the actual poʃseʃsion
of the same premises hereby bargained and sold or intended so to be
with appurtenances and thereby be enabled to take or? grant and
release of the reversion freehold and inheritance of the same and every
part thereof unto and to the use of the said James Smith Archibald
Smith and Robert McCunn their heirs and assigns for ever by Indenture
intended to bear date the day next after the day of the date of these
presents In witness whereof the parties to these presents have
hereunto set their hands and seals the day and year first above written
