Part 341s – Smith Robertson Genealogy – Indenture Research – 1837 James & Archibald Smith

And here I return to my Indenture Transcription Project in the search and research for the origins, ancestry and genealogy of my ggg-grandfather James Smith.  I am now working on a new FHL microfilm of the Grenada Registers of Records.  It includes the dates 1837 to 1881 and is v. Z2-G3.

This first Document is a first part of an Indenture dated 30 May 1837 and entered to the Grenada Registers of Records 14 July 1837. It most definitely is not a Document concerning ggg-grandfather James Smith. It appears to involve the James and Archibald Smith of Glasgow, Scotland and their previously known partner Robert McCunn.

The images of the two Pages 254 and 254 are downloaded from Item 1 of the microfilm FHL [1563330], Registers of records 1837-1881 (v. Z2-G3).


Here is my transcription. (I definitely would like to thank this scribe one day.)

Entered 14th July 1837
This Indenture made the thirtieth day of March in the year of our
Lord One thousand eight hundred and thirty seven Between Robert Mc
Cunn of the City of Glasgow Merchant of the one part and James Smith
and Archibald Smith of the same place Merchants of the other part

witnesseth

Witnesseth that the said Robert McCunn for and in consideration of
the sum of Five shillings of lawful money of Great Britain to him in hand well
and truly paid by the said James Smith and Archibald Smith at or before
the sealing and delivery of these presents the receipt whereof is hereby acknowledge
ed Hath bargained and sold and by these Presents Doth bargain and sell
unto the said James Smith and Archibald Smith their executors and administrators
and assigns All the part share and proportion of him the said Robert McCunn
of and in all singular the Plantations Messuages Lands Tenements Rights
to services of Apprenticed Labourers and Hereditaments situate and being in the
Island of Grenada and elsewhere in the West Indies and other the Hereditaments
and real Estate wheresoever situate or being vested in or belonging to them the said
James Smith Archibald Smith and Robert McCunn (whether as Mortgagees Own
ers or part Owners or otherwise) as Copartners and joint Trustees with all and sin
gular the rights members and appurtenances thereunto belonging or in any wise
appertaining And the Reversion and Reversions Remainder and Remainders year
ly and other rents issues and profits thereof To have and to hold the said
Plantations Messuages Lands Tenements Rights to services of apprenticed Labourers
Hereditaments and all and singular other the premises whatsoever hereby bargained
and sold or intended so to be with their and every of their appurtenances unto the
said James Smith and Archibald Smith their executors administrators and
assigns from the day next before the day of the date of these Presents for and dur
ing the full end and term of One Year from thence next ensuing and fully to
complete and ended Yielding and paying therefore at the expiration of the said tem
unto the said Robert McCunn his heirs or assigns the Rent of One Pepper Corn if the
same shall be lawfully demanded To the intent and purpose that by virtue of these
Presents and by force of the Statute made for transferring uses into possession the said
James Smith and Archibald Smith may be in the actual possession of all and sin
gular the said premises hereby bargained and sold with the appurtenances and may
be thereby enabled to accept and take a Grant and Release of the Reversion Free-
hold and Inheritance thereof to them the said James Smith and Archibald Smith
their heirs and assigns To the only proper use and behoof of the said James Smith
and Archibald Smith their heirs and assigns for ever In Witness whereof the said
Parties to these Presents hereunto set their hands and seals the day and year first
