Part 441s – Smith Robertson Genealogy – Indenture Research – 1821 GGG-Grandfather James Smith – Good Hope Estate

Evening,

And tonight’s supper was a variation on Aloo Palak Sabji. I added cherry tomatoes from the garden and fresh zucchini, and then I accompanied each plate with home-made Roti. Good food for a cold Tampa night. The inserted image is of Palak. The store I bought it at labeled it Water Spinach.

Thank you for the positive compliments that I have recently received regarding my work on A Genealogy Hunt. My presented work online is a journal of my research and search for my genealogy and family ancestry. It is a way that I am able to organize myself without having to leaf through many hand-written notebooks and reams of paper. And yes, at times, it can seem overwhelming… I have come to a personal conclusion that genealogy is not for the feint-of-heart or for those who cannot muddle through with the lessons of the development of patience.

Continuing in my Transcription Project, the next Indenture is, all-things-being-equal, referential to ggg-grandfather James Smith. This Document is another “One Pepper Corn Rent” contract between ggg-grandfather James and one Mary Jane Marecheaux, which I believe is the spelling of name that I can make out. There are no immediate or explicit clues as to ggg-grandfather James’ origins.

I am a wee bit perplexed by the intent of this Indenture in its reference to Good Hope Estate. I’m not sure of the wording, and as I am not either a surveyor nor a contract lawyer, as to whether ggg-grandfather is selling Good Hope Estate or just some portion of land thereof.

This Indenture made the seventh day of September in the
year of Our Lord One thousand eight hundred and twenty One Between
James Smith of the parish of Saint George in the Island of Grenada Mill
Carpenter of the one part and Mary Jane Marecheaux of the parish of Saint
George in thesaid Island of the other part Witne∫seth that thesaid James Smith
in Consideration of five shillings of lawful money of Great Britain to him in hand
paid by thesaid Mary Jane Marecheaux at or before the ensealing and delivery of these
presents (the receipt is hereby acknowledged) and for other said causes and considera
tions him thesaid James Smith hereto specially _____ Hath bargained and
sold and by these presents Doth bargain and sell unto thesaid Mary Jane Marecheaux
her Executors administrators and assigns All that Lot piece or parcel of land
situate lying and being in the parish of Saint George in the Island aforesaid
heretofore forming part and parcel of Good hope Estate and Containing by estimation
Six Acres and ten perches be the same little more or le∫s and bounded on the West
by Mount Parrs∫sus Estate on the South by the public road leading from the
Town of St. Georges to the parish of Saint David on the East partly by lands
belonging to thesaid James Smith ^and on the North by lands belonging to thesaid James Smith or howsoever otherwise the said Lot piece or
parcel of land may be known or described together with all and singular the
Me∫suages Building tenements and other the Erections on thesaid Lot piece
or parcel of land and premises erected built standing or being and also all Ways
paths passages hedges ditches Wells Waters profits Commodities advantages
emoluments and hereditaments whatsoever to the same premises or any
part thereof belonging or in anywise appertaining or therewith at any time
held used occupied possessed or enjoyed or accepted reputed deemed taken or known
as part parcel or member thereof or of any part thereof and the reversion and
reversions remainder and remainders rents i∫sues and profits thereof and of any
part and parcel thereof To have and to hold thesaid Lot piece or parcel of land
tenements hereditaments and all other the premises mentioned or intended
to be hereby bargained and sold with their and every of their rights members and
appurtenances unto thesaid Mary Jane Marecheaux her executors adminis
trators and assigns from the day next before the day of the date of these presents
for and during and unto the dull end and term of one whole year from thence next
ensuring and fully to be complete and ended Yielding and paying therefor
at the end of thesaid term the rent of one pepper corn if the same shall be
lawfully demanded To the intent that by virtue of these presents and by force
of the statute for transferring uses into possession she thesaid Mary Jane
Marecheaux may be in the actual possession of thesaid let piece or parcel of
land tenements hereditaments and all and singular other the monies
mentioned or intended to be hereby bargained and sold with their and every of
their appurtenances rights members and appurtenances and thereby be
enabled to accept and take a Grant and release of the reversion and inheritance
thereof

as shall be declared in an Indenture of Release intended to bear date the
day nest adter the day of the date hereof and made or mentioned to be made
between the same parties as are parties to these presents In Witne∫s
